For Caregivers

It can be overwhelming to care for an elderly parent or relative. Many people know it would help to plan ahead, but it’s hard to know where to start. When juggling work, family and caregiving, there’s no time for research. If the time comes that you can no longer care for your loved one by yourself, many people worry about how a nursing home could take your loved one’s home and everything they worked a lifetime to earn. 

It is easy to put off making decisions until a crisis forces you to act. But with our Advanced Planning help, we can guide you in making a good plan. You will have peace of mind knowing your loved one will get the care he or she needs, while family assets are protected.

For Older Adults

If you don’t plan at all and end up needing long term care, you will likely spend your life savings in a very short time. As a result you will not be able to pass anything on to your loved ones. You have worked hard and don’t want it all to go to a care facility or the government… this would be hard to swallow. 
The more in advance one can plan, the more options are available and the less expensive the planning will be. Crisis planning is needed when something unexpected happens– a fall, a stroke, the death of a caretaker spouse – and your loved one is no longer able to live alone. Often, they have too many assets to qualify for Medicaid. Your family is now in a crisis and needs to protect what assets you can, and spend down other assets quickly and legally.

With Crisis Planning, we will guide family caregivers from start to finish to help you protect the legal, financial, and personal well-being of your loved ones who need immediate care outside the home.  Our plans are customized to meet the needs of each client, and we take immediate action to protect assets and apply for Medicaid so the cost of care does not bankrupt the family.

The Process

Step 1

Contact us to tell us a little about your situation and whether you need Advance Planning or Crisis Planning. If working with us is the right fit, we move on to the initial consultation phase.

Step 2

You will complete and submit a comprehensive intake questionnaire and we will review your information and set up a one hour consultation.  Depending on your situation, attorney Vance Parker may participate in the initial consultation, during which you can ask questions and take notes.  Afterwards, you can take all the time you need to decide what services you would like.

Step 3

Once you engage our services, we work closely with you from beginning to end. For instance, with the Comprehensive Medicaid Package, we start with helping you gather information and then handle the Medicaid application process through the entire review period, which can last up to 45 days.  We advocate for your family the entire time, provide additional documentation as called for, and keep you informed throughout the whole process.

Frequently Asked Questions

Many people are unaware that Medicare will only pay for a nursing home for up to 100 days.  Medicare will pay the total cost of care for the first 20 days, and then requires the family to pay a hefty co-pay of almost $200 a day for the remaining days.  Unfortunately, Medicare often stops paying on day 20, claiming that the patient’s condition is not improving.  Therefore those in need of long term care will likely have to depend on Medicaid at some point.

The confusing Medicaid process can lead people to submit their loved one’s application with unknown errors, which risks delay. And because of strict deadlines, this delay can cause the denial of an application.  In addition, Medicaid reviews 5 years of all financial statements, and many people underestimate the amount of time it takes to gather and review these documents.  Most people don’t have the experience to know what Medicaid looks for and what transactions will cause problems or require additional documentation.  We catch potential problems and “cure” them up front, which saves time when working against a deadline, and prevents a denial when we are able to correct something before Medicaid can sanction it.

Medicaid is need based, so the elder can only have $2,000 in “countable” assets in order to qualify.  Often when you talk to a Medicaid office or the nursing home where your loved one is placed, they will tell you that you have to spend down all of your loved one’s assets, except for their home.  But that is just not the case.  Parker Eldercare works hand in hand with Vance Parker Law, PLLC to take advantage of various exemptions to help you purchase, retain or re-characterize certain assets, while still qualifying for Medicaid.

Assisted Living and Skilled Care Medicaid programs have a 3 and 5 year “look back period.” Assets gifted (transferred) to any third party will either make you ineligible for Medicaid or cause a transfer penalty where you must private-pay a facility for a period of time. There are complicated formulas and processes to “cure” the gifts, and there are loopholes and exemptions that the average person, and often the Medicaid caseworkers themselves, do not know about.  Some clients consult with the Medicaid office before coming to us, and we caution you to not accept Medicaid’s determination of potential gift transfers, as the case workers often DO get it wrong.

We have the knowledge and experience to efficiently and compassionately handle every part of the Medicaid application process.  We tackle the critical task of reviewing 5 years of financial statements and know how to “cure” gifts and recommend the best options for “spending down.” We advocate for you with the case worker, keep track of deadlines and provide policy and case law if the caseworker is unsure of the laws themselves. We stay by your side from our initial consultation until the day you receive your benefits decision from Medicaid.
