Advance Planning for long term care

Advance Planning Guide

If you would like to proactively plan ahead in the event you or a loved one might need long term care, we will have you complete an intake form to give us a snapshot of you (and your spouse’s) assets and income, family situation, and existing estate documents. After reviewing your intake form and estate documents, we’ll set up a consultation where we will provide recommendations and options.  You’ll be able to ask questions and discuss which options are most appealing to you. If some options require legal discussion, we will briefly include attorney Vance Parker in the consultation.  If you find you’d like more in-depth information about legal questions or documents, you’ll be able to set up a full consultation with Vance later on.

After our consultation, you’ll receive a written, step by step guide that gives you a customized plan for moving forward.  The guide provides the following:  An overview of your current financial and legal situation, as well as future options discussed on the call.  A detailed description of how you can best protect your assets from the debilitating cost of long term care.  An estimate of the cost of long term care in your area. Referrals to our colleagues who can assist with other benefits programs, if applicable. Vance’s assessment of your current Financial Power of Attorney, if applicable. A $350 credit toward our 5 Year Financial Statement Assessment services.

Crisis Planning for long term care

Financial Statement Assessment

In the last five years, have you gifted money to relatives or friends, bought presents for others, or helped a relative out with a bill? If so, you could be at risk for a transfer penalty! Under federal Medicaid law, the transfer of assets within the five years prior to applying for Medicaid is called a transfer penalty and will render you ineligible for Medicaid if not remedied. Upon submission of your Medicaid application, the last five years of your bank statements will be meticulously scrutinized for these transfer penalties and for other transactions that are a red flag for Medicaid qualification.

This review by Medicaid is one of the most complex and rigorous steps of the application process and causes many families to have their applications rejected.  You don’t want to leave this step up to chance. By having our expert team assess your banks statements ahead of the application process, you can ensure that your application will have the best chance of being approved. The review will include a written analysis of both income and expenses, as well as recommendations on how to cure any issues that are discovered. If you later decide you would like the Comprehensive Medicaid Package, you will receive a $500 credit toward that service.

Comprehensive Medicaid Package

We have developed a two step process for handling your Medicaid application from beginning to end. First, we review the last 5 years of all financial statements for potential gift transfers and other red flags that Medicaid typically questions. In the rare case where the financial statements indicate a very complex scenario requiring complicated resolutions to problems encountered, we consult with you about next steps. But typically, we can move on to the remainder of the process.

Based on the financial statement review, we recommend cures to gifts and provide options for “spend downs.” We review life insurance policies and funeral contracts. We involve attorney Vance Parker to review your financial power of attorney and offer suggestions for protecting the home from Estate Recovery. We also provide notarial services related to further legal work that you might need, like re-deeding the house, promissory notes, trusts and caretaker agreements. (Attorney Vance Parker would provide a separate consultation and legal fee quote for drafting legal documents.)

We prepare and submit the Medicaid application and provide full advocacy during the 45 day application period, including working with the nursing facility to obtain required forms and information, answering Medicaid caseworker questions and providing them with additional requested information, researching special circumstances, contacting the State level of Medicaid office if need be, aiding in contacting the Department of Veteran’s Affairs if need be, keeping track of deadlines, and providing the caseworker with case law and Medicaid policy citations if they don’t know the laws and policies themselves (which they often don’t).  We keep you informed and fight tenaciously for you from beginning to end.
